ПРОБЛЕМИ ВЗАЄМОДІЇ СІЛЬСЬКОГОСПОДАРСЬКИХ КООПЕРАТИВІВ ТА ОРГАНІВ ОБ'ЄДНАНОЇ ТЕРИТОРІАЛЬНОЇ ГРОМАДИ В УМОВАХ ДЕЦЕНТРАЛІЗАЦІЇ ВЛАДИ
Анотація
Статтю присвячено проблемам взаємодії сільськогосподарських кооперативів та органів об'єднаної територіальної громади в умовах децентралізації влади.
Вважаємо, що органи об'єднаних територіальних громад повинні виконувати такі функції: розміщення інформації про можливі закупівлі та постачання сільськогосподарської продукції і продовольства на сайті ОТГ; у межах встановлених повноважень сприяти суб'єктам сільськогосподарської кооперації в укладанні угод про співробітництво з суб'єктами господарювання, які фінансуються за рахунок коштів ОТГ; забезпечення фінансової підтримки в межах програм розвитку фермерських господарств та сільськогосподарської кооперації тощо.
Вирішення цієї проблеми має бути в площині трьох зацікавлених суб'єктів правових відносин: власників особистих селянських господарств, органів сільської об'єднаної територіальної громади та держави. По-перше, в Законі Україні "Про особисте селянське господарство" необхідно чітко ідентифікувати особисте селянське господарство з урахуванням відповідних нормативів площ землекористування, утримання сільськогосподарських тварин та цілей використання отриманої сільськогосподарської продукції (виключно на власне самозабезпечення). Крім того, необхідно залучити особисті селянські господарства у формальні економічні відносини з метою легалізації доходів, отриманих від ведення ОСГ.

INTERACTION PROBLEMS OF AGRICULTURAL COOPERATIVES AND BODIES OF THE UNITED TERRITORIAL COMMUNITY IN THE CONDITIONS OF DECENTRALIZATION OF POWER
Summary
The article is devoted to the interaction problems of agricultural cooperatives and bodies of the united territorial community (UTC) in the conditions of decentralization of power.
According to the results of the research, the development of agricultural cooperation is not possible without the significant support of the governing bodies of the united territorial community.
We believe that the bodies of the united territorial communities should perform the following functions: posting information on possible purchases and supplies of agricultural products and food on the UTC website; within the established powers to assist the subjects of agricultural cooperation in concluding agreements on cooperation with economic entities, which are financed at the expense of UTC; providing financial support within the programs of development of farms and agricultural cooperation, etc.
At the same time, the subjects of agricultural cooperation, territorially located within the UTC, must ensure: the creation of conditions for the purchase of agricultural products and raw materials from the rural population; organization of training for cooperatives; promoting the development of all types of cooperative relations; to participate in the organization and holding of weekend fairs, seasonal fairs for the sale of agricultural products in rural areas of the united territorial community.
We consider that the bodies of the united territorial communities should perform the following functions: posting information on possible purchases and supplies of agricultural products and food on the UTC website; within the established powers to assist the subjects of agricultural cooperation in concluding agreements on cooperation with economic entities, which are financed at the expense of UTC; providing financial support within the programs of farms development and agricultural cooperation, etc.
We set out that an important stimulus for the development of agricultural cooperatives should be financial support through grants under the regional program of fsrms development and agricultural cooperatives, where the financial donor is a united rural community.
According to the results of calculations, the greatest tax burden per unit area of agricultural land have entrepreneurs — individuals, the least — personal farms.
The solution to this problem should be in the plane of three interested subjects of legal relations: the owners of personal peasant economy, the bodies of the rural united territorial community and the state. First, the Law of Ukraine "On Personal Peasant Economy" must clearly identify personal farming, taking into account the relevant standards of land use, livestock and purposes of use of agricultural products (solely for self-sufficiency). In addition, it is necessary to involve private farms in formal economic relations in order to legalize the income received from the maintenance of PPE.
We believe that the bodies of local territorial communities should stimulate, using economic and administrative methods for the transformation of personal farms into business entities, various organizational and legal forms of management in the field of agrarian business.
