РОЗВИТОК ЗЕМЕЛЬНИХ ОРЕНДНИХ ВІДНОСИН В АГРАРНОМУ СЕКТОРІ ЕКОНОМІКИ

Анотація

Досліджено генезу розвитку земельних орендних відносин в аграрному секторі економіки України. Показано, що нині оренда земель є основним способом використання земельних часток (паїв) в Україні особами, що одержали державні акти на право їх власності; займає чільне місце в системі економічного обороту сільськогосподарських угідь. Визначено тенденції змін рівня орендної плати за землі сільськогосподарського призначення, динаміки форм орендної плати за земельні частки (паї) і суб'єктного складу укладених договорів оренди земельних часток (паїв), структури укладених договорів оренди земельних часток (паїв) в Україні за строком їх дії. Підтверджено, що механізм земельних орендних відносин в аграрному секторі економіки є повною мірою ринковим, а ринок прав оренди, зокрема на земельні ділянки сільськогосподарського призначення державної та комунальної власності, — висококонкурентним ринком. Державне регулювання земельних орендних відносин необхідно здійснювати у напрямах контролю за суворим дотриманням істотних умов договорів оренди, протидії тіньовому обороту земель через їх оренду та емфітевзис.

DEVELOPMENT OF THE LAND LEASE RELATIONS IN THE AGRARIAN SECTOR OF ECONOMY

Summary

Genesis of development of the land lease relations in the agrarian sector of the economy of Ukraine is studied. We showed that lands lease is the main direction of land shares' (pay) using in Ukraine by persons, who have received the certificates of title under the land transfer act now; it also takes the main place in the system of agricultural lands' human activity. Tendencies of change in the rent value for agricultural lands, dynamics of forms of rent for land shares (pay) and subject structure of signed agreements on land shares (pay) lease, structure by contract duration of signed agreements on land shares (pay) lease in Ukraine are determined. It is confirmed that the mechanism of land lease relations in the agrarian sector of economy is fully market; and a market of the lease rights, in particular on agricultural land plots of the state and municipal ownership, — is the highly competitive market. State regulation of the land lease relations needs to be carried out towards control of strict adherence to essential lease agreements specifications, counteractions to shadow land turnover through its lease and emphyteusis.
