ТЕОРЕТИЧНІ ЗАСАДИ ФОРМУВАННЯ ТЕРИТОРІАЛЬНИХ ГРОМАД: ІМПЛЕМЕНТАЦІЯ СВІТОВОГО ДОСВІДУ В УКРАЇНУ
Анотація
У пропонованій статті досліджено територіальні громади як форму організації місцевої влади в країнах світу та виявлено характеристики, що їх об'єднують: соціальна взаємодія, територія, загальний зв'язок. Здійснено системний аналіз структури цих спільнот як самоврядних територіальних одиниць в Україні, визначено та охарактеризовано їх ознаки (територіальну, інтегративну, інтелектуальну, майнову, фіскальну та самоврядну) на підставі норм чинних законодавчих актів. Запропоновано класифікувати територіальні громади на громади базового та асоційованого рівнів, які різняться за: особливостями організації повсякденного життя; соціологічними, економічними та культурними особливостями; специфічними інтересами цих важливих соціальних спільнот та реалізацією ними функцій і повноважень, закріплених у законодавстві. Акцентовано увагу на функціях, як важливої форми владно-управлінського впливу, призначенням яких є виконання важливих питань місцевого значення. Функції диференційовано за: 1) об'єктами, суб'єктами, способами, засобами і методами муніципальної діяльності територіальних громад; 2) рівнями управління; 3) суб'єктом і обсягом впливу, засобами реалізації. Їх систематизовано та наведено у структурно-логічній схемі. На підставі проведеного дослідження доведено необхідність у визначенні на законодавчому рівні правового статусу громади і тим самим визнати її одиницею адміністративно-територіального устрою. Обгрунтовано, що завданням децентралізації влади є перерозподіл повноважень, а об'єднаних територіальних громад — формування меж територій.

THEORETICAL PRINCIPLES OF FORMATION OF TERRITORIAL COMMUNITIES: IMPLEMENTATION OF WORLD EXPERIENCE IN UKRAINE
Summary
The proposed article explores territorial communities as an organizational form of local government in the western countries and identifies their common characteristics: social interaction, territory, general communication. A systematic analysis of the structure of these communities as self-governing territorial units in Ukraine has been made and their features (territorial, integrative, intellectual, property, fiscal and self-rule) are determined and characterized based on the norms of the current legislative acts. It is proposed to classify the territorial communities as the ones of the basic and associated levels, which differ in: the peculiarities of the organization of everyday life; sociological, economic and cultural peculiarities; the specific interests of these important social communities and the realization of their functions and powers enshrined in the law. The emphasis is on functions as an important form of power and management influence, the purpose of which is to perform important issues of local importance. Functions are differentiated by: 1) objects, subjects, methods, means and methods of municipal activity of territorial communities; 2) management levels; 3) the subject and volume of influence, means of implementation. They are systematized and presented in the structural-logical scheme. On the basis of the study, the necessity to determine at the legislative level the legal status of the community has been proved, and thus to recognize it as the unit of the administrative-territorial system. It is substantiated that the task of decentralization of power is the redistribution of powers, and the united territorial communities — the formation of boundaries of territories.
