ПУБЛІЧНІ ЗАКУПІВЛІ: ТИПИ ТА ПРОЦЕДУРИ ЗДІЙСНЕННЯ

Анотація

Однією із форм співробітництва між державою та суб'єктами господарювання є відносини у сфері публічних закупівель, чим забезпечуються потреби державних підприємств, установ та організацій в товарах, роботах та послугах. Здійснення публічних закупівель передбачає певні процедури та механізми, що визначені в Законом України "Про публічні закупівлі" та низкою підзаконних документів (Положень, Порядків, Інструкцій). Мета статті полягає у визначенні чітких процедур у сфері публічних закупівель у відповідності до їх видів, а також обгрунтуванні основних етапів, періодів та алгоритмів проведення закупівель за бюджетні кошти. Для досягнення поставленої мети використано методи аналізу та синтезу, табличний та графічний методи дослідження тощо. Визначено, що існують два типи публічних закупівель: допорогові та надпорогові закупівлі. Встановлено основний склад та наповненість документів, що надаються ініціатором закупівель, а також опис технічних вимог до предмета закупівлі під час "допорогів". Наведено алгоритм проведення допорогових закупівель та порядок договірного процесу. Визначено, що надпорогові закупівлі відбуваються з використанням однієї з трьох тендерних процедур: відкриті торги, конкурентний діалог та переговорна процедура закупівлі. Детально розглянуто кваліфікаційні вимоги, яким повинні відповідати учасники відкритих торгів. Визначено основні етапи проведення відкритих торгів, а також процедури та дії замовників та учасників на кожному з етапів. Дано характеристику причинам відхилення тендерних пропозицій та відміни торгів. Встановлено відмінності в процедурах "українських торгів" та "європейських торгів". Детально розглянуто процедури та особливості проведення конкурентного діалогу на кожному з законодавчо-визначених етапів. Визначено відмінні риси переговорної процедури від двох інших процедур (відкритих торгів і конкурентного діалогу), а також підстави для її проведення. Розглянуто особливості та порядок проведення переговорної процедури згідно з чинним законодавством та здійснено порівняння із законодавчими вимогами, що втратили чинність. Узагальнено основні критерії та процедури, що притаманні кожному з типів публічних закупівель.

PUBLIC PROCUREMENT: TYPES AND IMPLEMENTATION PROCEDURES

Summary

One of the forms of cooperation between the state and economic entities are the relations in the sphere of public procurement, which provide for the needs of state enterprises, institutions and organizations in goods, works, and services. Public procurement involves certain procedures and mechanisms, which are defined in the Law of Ukraine "On Public Procurement" and a number of by-laws (Regulations, Procedures, Instructions). The purpose of the article is to define clear procedures in the field of public procurement in accordance with their types, as well as to justify the main stages, periods and algorithms of procurement for budgetary funds. Methods of analysis and synthesis, tabular and graphical methods of research are used to achieve this objective. It has been determined that there are two types of public procurement: pre-threshold and over-threshold procurement. The main composition and content of documents provided by the procurement initiator, as well as the description of technical requirements for the subject matter of the procurement during the "pre-threshold" have been established. The algorithm of "over-threshold" procurement and the procedure of the contract process are given. It has been determined that "over-threshold" procurement takes place using one of three tender procedures: open bidding, competitive dialogue and negotiation procedure of procurement. The qualification requirements that open bidders must meet are discussed in detail. The main stages of open bidding are defined, as well as the procedures and actions of customers and participants at each stage. This description describes the reasons for the rejection of tenders and cancellation of tenders. Differences in the procedures of "Ukrainian trades" and "European trades" have been established. Procedures and peculiarities of conducting competitive dialogue at each of the legislative stages are discussed in detail. The distinctive features of the negotiation procedure from the other two procedures (open bidding and competitive dialogue) are defined, as well as the grounds for its holding. The peculiarities and procedure of the negotiation process in accordance with the current legislation are considered and the comparison with the invalid legislative requirements is made. The main criteria and procedures specific to each type of public procurement are summarized.
